David Bradley, Head of Employment at Ramsdens Solicitors, has featured in HR Grapevine where he discusses a recent case of alleged discrimination concerning a worker who claimed that he was fired for being HIV positive and is now suing his employer.
David Bradley, told HR Grapevine that legally this should 'NEVER' happen. He too pointed towards the Equality Act 2010 under UK law. “This should mean equal assessment on qualifications and merits for the job and definitely not a basis for not selecting someone or asking them to leave.
“Does it happen in practice? As with every facet of discrimination, probably. However, if there is evidence or a presumption that discrimination has taken place damages are available.”
